GeneralProvisions

Article1People'scongressesandpeople'sgovernmentsshallbeestablishedinprovinces,autonomousregions,municipalitiesdirectlyundertheCentralGovernment,autonomousprefectures,counties,autonomouscounties,cities,municipaldistricts,townships,nationalitytownships,andtowns.

Article2Standingcommitteesshallbeestablishedbylocalpeople'scongressesatandabovethecountylevel.

Article3Theorgansofself-governmentofautonomousregions,autonomousprefecturesandautonomouscountiesshall,inadditiontoexercisingthefunctionsandpowersspecifiedinthisLaw,exercisethepowerofautonomywithinthelimitsoftheirauthorityasprescribedbytheConstitution,theLawonRegionalNationalAutonomyandotherlaws.

ChapterII

LocalPeople'sCongressesatVariousLevels

Article4Localpeople'scongressesatvariouslevelsshallbelocalorgansofStatepower.

Article5Deputiestothepeople'scongressesofprovinces,autonomousregions,municipalitiesdirectlyundertheCentralGovernment,autonomousprefecturesandcitiesdividedintodistrictsshallbeelectedbythepeople'scongressesatthenextlowerlevel;deputiestothepeople'scongressesofcounties,autonomouscounties,citiesnotdividedintodistricts,municipaldistricts,townships,nationalitytownships,andtownsshallbeelecteddirectlybytheirconstituencies.

Thenumberofdeputiestothelocalpeople'scongressesatvariouslevelsandthemanneroftheirelectionshallbeprescribedbytheelectorallaw.Thereshallbeanappropriatenumberofdeputieselectedfromtheminoritynationalitiesineachadministrativearea.

Article6Thetermofofficeofthelocalpeople'scongressesatvariouslevelsshallbefiveyears.

Article7Thepeople'scongressesofprovinces,autonomousregions,andmunicipalitiesdirectlyundertheCentralGovernmentmay,inthelightofthespecificconditionsandactualneedsoftheirrespectiveadministrativeareas,formulateandpromulgatelocalregulations,whichmustnotcontravenetheConstitutionandotherlaws,aswellasadministrativeregulations;theyshallreportsuchlocalregulationstotheStandingCommitteeoftheNationalPeople'sCongressandtheStateCouncilfortherecord.

Thepeople'scongressesofcitieswhereprovincialandautonomousregionalpeople'sgovernmentsarelocatedandthepeople'scongressesofrelativelylargecitieswiththeapprovaloftheStateCouncilmay,inthelightofthespecificconditionsandactualneedsoftheirrespectivecities,formulatelocalregulations,whichmustnotcontravenetheConstitutionandotherlaws,administrativeregulations,andthelocalregulationsoftheirrespectiveprovincesandautonomousregions;theyshallreportsuchlocalregulationstothestandingcommitteesofthepeople'scongressesoftherespectiveprovincesandautonomousregionsforapprovalbeforeimplementationandforsubmissiontotheStandingCommitteeoftheNationalPeople'sCongressandtheStateCouncilfortherecord.

Article8Localpeople'scongressesatandabovethecountylevelshallexercisethefollowingfunctionsandpowers:

（1）toensuretheobservanceandexecution,intheirrespectiveadministrativeareas,oftheConstitutionandotherlaws,administrativeregulationsandtheresolutionsofthepeople'scongressesandtheirstandingcommitteesathigherlevels,andtoensuretheimplementationoftheStateplanandtheStatebudget;

（2）toexamineandapprovetheplansfornationaleconomicandsocialdevelopmentandbudgetsoftheirrespectiveadministrativeareasandthereportsontheimplementationofsuchplansandbudgets;

（3）todiscussanddecideonmajorissuesinpolitical,economic,educational,scientificandculturalaffairs,publichealth,protectionoftheenvironmentandnaturalresources,andcivilandnationalityaffairs,intheirrespectiveadministrativeareas;

（4）toelectthemembersoftheirrespectivestandingcommittees;

（5）toelectgovernorsanddeputygovernors,chairmenandvice-chairmenofautonomousregions,mayorsanddeputymayors,prefectsanddeputyprefects,andheadsanddeputyheadsofcountiesanddistricts;

（6）toelectthepresidentsofthepeople'scourtsandthechiefprocuratorsofthepeople'sprocuratoratesatthecorrespondinglevels;theelectionofthechiefprocuratorofapeople'sprocuratorateshallbereportedtothechiefprocuratorofthepeople'sprocuratorateatthenexthigherlevel,whoshallsubmitittothestandingcommitteeofthepeople'scongressatthatsamelevelforapproval;

（7）toelectdeputiestothepeople'scongressesatthenexthigherlevel;

（8）tohearandexaminereportsontheworkofthestandingcommitteesofthepeople'scongressesatthecorrespondinglevels;

（9）tohearandexaminereportsontheworkofthepeople'sgovernments,thepeople'scourtsandthepeople'sprocuratoratesatthecorrespondinglevels;

（10）toalterorannulinappropriateresolutionsofthestandingcommitteesofthepeople'scongressesatthecorrespondinglevels;

（11）toannulinappropriatedecisionsandordersofthepeople'sgovernmentsatthecorrespondinglevels;

（12）toprotectthesocialistpropertyownedbythewholepeople,propertyownedcollectivelybyworkingpeopleandcitizens'legitimateprivateproperty,maintainpublicorderandsafeguardcitizens'rightsofthepersonandtheirdemocraticandotherrights;

（13）toprotectthelegitimaterightsandinterestsofvariouseconomicorganizations;

（14）tosafeguardtherightsofminoritynationalities;and

（15）tosafeguardwomen'srightsasendowedbytheConstitutionandotherlaws,suchasequalitywithmen,equalpayforequalworkandfreedomofmarriage.

Article9Thepeople'scongressesoftownships,nationalitytownships,andtownsshallexercisethefollowingfunctionsandpowers:

（1）toensuretheobservanceandexecution,intheirrespectiveadministrativeareas,oftheConstitution,otherlaw,administrativeregulations,andtheresolutionsofthepeople'scongressesandtheirstandingcommitteesathigherlevels;

（2）toadoptandpromulgateresolutionswithinthescopeoftheirfunctionsandpowers;

（3）todecide,inaccordancewithStateplans,onplansforthedevelopmentoftheeconomy,culturalaffairsandpublicservicesintheirrespectiveadministrativeareas;

（4）toexamineandapprovethebudgetsoftheirrespectiveadministrativeareasaswellasthereportsontheimplementationofthebudgets;

（5）todecideonplansforcivilaffairsintheirrespectiveadministrativeareas;

（6）toelectthechairmanandvice-chairmenofthepeople'scongressatthecorrespondinglevel;

（7）toelectheadsanddeputyheadsoftownshipsandtowns;

（8）tohearandexaminereportsontheworkofthepeople'sgovernmentsoftownships,nationalitytownships,andtowns;

（9）toannulinappropriatedecisionsandordersofthepeople'sgovernmentsoftownships,nationalitytownships,andtowns;

（10）toprotectthesocialistpropertyownedbythewholepeople,propertyownedcollectivelybyworkingpeopleandcitizens'legitimateprivateproperty,tomaintainpublicorderandsafeguardcitizens'rightsofthepersonandtheirdemocraticandotherrights;

（11）toprotectthelegitimaterightsandinterestsofvariouseconomicorganizations;

（12）tosafeguardtherightsofminoritynationalities;and

（13）tosafeguardwomen'srightsasendowedbytheConstitutionandotherlaws,suchasequalitywithmen,equalpayforequalworkandfreedomofmarriage.

Inexercisingtheirfunctionsandpowers,thepeople'scongressesoftownships,nationalitytownships,andtownsinwhichminoritynationalitiesliveinconcentratedcommunitiesshalladoptspecificmeasuresappropriatetothecharacteristicsofthenationalitiesconcerned.

Article10Localpeople'scongressesatvariouslevelsshallhavethepowertoremovefromofficemembersofthepeople'sgovernmentsatthe
