Article1inordertostrengthenthecitygreeningmanagement,promotethedevelopmentofcitygreeninginthecity,accordingtotheStateCouncil"

citygreeningOrdinance"

and"

Jiangsucitygreeningmanagementregulations"

（hereinafterreferredtoasthe"

Regulations"

）,withtheactualcity,theenactmentofthisapproach.

Secondofthepeople'

sGovernmentoftheMeasuresapplytothecityadministrativeareaofurbanareas,scenicareas,countygreeningplanning,construction,protectionandmanagementofcitiesandtowns.

Third,NanjingCityGardenbureauisresponsibleforthecity'

surbangreeningwork;

districtandcountyurbanconstructionmanagementdepartmentsinaccordancewiththelawwithinthejurisdictionofurbangreeningwork.

Fourthcity,districtandCountyPeople'

sgovernmentsshallbringthecitygreeningconstructionintoplansfornationaleconomicandsocialdevelopment,toencourageand

strengthenthescientificresearchofcitygreening,popularizetheadvancedtechnology,theintroductionofexcellentspecies,graduallyreplacetheexistingvarietiesoftrees,plantinglawns,flowers,inverticalgreening,improvethecitygreenscienceandtechnologyandartthelevelof.

Theplanning,constructionandconstructionofnewurbanareas,oldurbanreconstructionareas,urbanandruralfringe,riversides,squares,stationsandpiersmustbecarriedoutinaccordancewiththeregulationsoftheprovinceandthesemeasures.

Fifthcity,districtandCountyPeople'

sGovernmentshallstrengthenthecitygreeningwork,organizethemassestocarryoutvoluntarytreeplantingactivities,inaccordancewiththeplanning,afforestation,plantingflowersandgrass,toexpandthegreenarea,improvingthelevelofafforestation.

Sixthunitsinthecityandthecitizenswiththeabilitytoworkshouldfulfilltheobligationsofplantingtreesorotherafforestationinaccordancewiththerelevantprovisionsofthestate.Anyunitorindividualshallhavetherighttostopthedamagetothegreeningandgreeningfacilities.Thepeople'

sgovernmentsofcities,districtsandcountiesshallcommendandrewardtheunitsandindividualswhohavemadeoutstandingachievementsinurbangreeningwork.

SeventhmunicipalgardenBureauandtheMunicipalPlanningBureauandotherdepartmentstoprepareanddemonstratethecity'

surbangreenplanning,reportedtotheMunicipalPeople'

sgovernmentapproval,intotheoverallurbanplanning.

Eighthrequirementsandcontentsforthepreparationofurbangreeningplansshallbeimplementedinaccordance

withtherelevantregulationsoftheprovincialregulations.Allunitsshallplantheancillarygreenspaceoftheirunits,withanareanotlessthan30%ofthetotalland

areaoftheunit.

Ninthprojectsshouldbearrangedforacertainnumberofgreenland,theuseofgreenspaceinthetotalareaofconstructionprojectsandtheproportionofland,respectively:

（1）anewresidentialareashallnotbelessthan30%,oraconvertedresidentialareashallbenolessthan25%;

（two）schools,hospitals,nursinghomes,organs,groups,troopsandotherunitsandpublicculturalfacilitiesshallnotbelessthan35%;

（three）trunkroadsshallnotbelessthan20%,andtrunkroadsshallnotbelessthan15%;

（four）otherconstructionprojects,whicharelocatedintheurbanareas,shallnotbelessthan25%,andshallnotbelessthan30%inthesuburbsorcounties.

TheproportionoftheproportionofgreenlandusedbythesmallpublicconstructionfacilitiesinthereconstructionareaandthesmalladditionalconstructionprojectsandsupportingconstructionwillbedeterminedbytheMunicipalBureauofparksandparksinconjunctionwiththerelevantdepartments.

Thetenthaffiliatedgreeningengineeringconstructionproject,thedesignschemeandconstructionprojectshouldbetheprincipalpartoftheprojectplanninganddesignatthesametime,thecityBureauofparksafterexamination,atthesametimeandthedesignschemeofthemainpartoftheprojectapproval.

Therestorationofurbanclassicalgardensandtheexaminationandapprovalproceduresforthedesignofpublicgreenspacesshallbecarriedoutinaccordancewiththeprovisionsofthesixteenthregulationsoftheprovincialregulations.

Eleventhinthecitypublicgreenspace,protectiongreenland,productiongreen（notincludingthetownsoftheforest,nursery,gardenandorchard）andscenicforestgreeningandroadgreening,greentrees,thegardendepartmentisresponsiblefororganizingtheconstruction;

constructionandexpansion,greeningandaffiliatedgreen

residentialareaofthebuildingtheconstructionunitshallberesponsiblefortheconstructionofgreen;

Thegreeningoftheexistingresidentialgreenareaisresponsiblefortheconstructionoftheresidentialareamanagementinstitution,andtheunitisresponsiblefortheafforestationofthegreenspace.Thegreenconstructionofresidentialgreenspaceandunitattachedgreenlandshouldreceivetechnicalguidancefromthelandscapedepartment.

Twelfthcityinnewconstruction,expansionandreconstructionprojectconstructionprojectsandresidentialprojects,thebasicconstructioninvestment

shouldincludesupportingthegreenconstructioninvestment,andunifiedarrangementofgreenconstruction,theconstructionunitsinthemainpartoftheprojectafter

thecompletionofthefirstseasoningreen.

Thedesignofthethirteenthurbanafforestationprojectsshallbeundertakenbytheconstructionunitsentrustedwiththedesignunitswithcorrespondingqualificationcertificates,andshallbesubmittedtotheMunicipalBureauofparksandparksforexamination.

ConstructionunitsmustobtaintheconstructionlicenseissuedbytheMunicipalBureauofparksandgardensbeforetheycanbeconstructedwithoutanyconstruction.

Fourteenthcitypublicgreenspace,protectiongreenland,scenicforest,greenproduction（notincludingthetownsoftheforest,nursery,gardenandorchard）,andgreentreesalongthegreenbelt,managedbythegardendepartmentresponsible;

eachunitwithinthescopeofthegreenspace,bytheresponsibleadministrativeunits;

greenresidentialarea,managedbytheresidentialareamanagementagencies;

nurseries,nurseries,operatedbytheunitresponsibleforthemanagementof.

Fifteenthcitygardenplantingteamprofessionalandpublicobligationsoftrees,ownershipandbenefitofstateorgans,schoolsandarmy;

andtheenterpriseowninvestmentinplantingtrees,ownershipandreturnstotheunit;

thegardendepartmentbytheunitforseedlings,plantingandmaintainingtrees,thetreeisvestedinthestate,the

woodfruitbytending;

residentsintheprivatecourtyardplantingtreesandattheirownexpense,theownershipofpersonalincome.

Sixteenth,nounitorindividualshallnotoccupyurbangreenlandwithoutpermission,andchangeitsnatureofuse.Whenplanningandapprovingprojects,urbanplanningdepartmentsshouldtrytokeeptreesandgreenspacesas

faraspossible.

Becausethestateconstructionneedstooccupythegreenspace,itmustbeapprovedbytheMunicipalBureauofparksandparks,andthelandofthesamesizeshallbecompensatedandthefeesforregreeningshallbepaid.ThetemporaryoccupancyofpublicgreenspacemustbeapprovedbytheMunicipalBureauofparksandparks,andthetemporaryoccupationfeesshallbepaidtothemunicipalgardenBureaubytheoccupyingunits.Afterthecompletionoftheproject,immediatelydismantledandrestoredtoitsoriginalcondition.

Seventeenth,nounitorindividualmaynothavethefollowingdamagetourbangreeninganditsfacilities:

（a）diggingbambooshootsinthepark,scenicarea,quarrying,deforestation,plantingweihuzaotian,hunting,grazing,cuttingbamboobuiltgraves;

（two）inthegreenlawns,flowerbeds,pilingupdebris,diggingdigging,damagedplants,inthetrunkofgraffitiluantie;

（three）twinewiresonthetrunk,anderectwiresandcables;

（four）pickingflowers,pickingfruits,harvestingseedsanddiggingChineseherbsinthegreenspace;

（five）thegreenofunauthorizedconstructionofbuildingsorstructures,treehousesorenclosuretrees,billboards;

（six）allkindsofpipelines,suchasdrainage,watersupply,airsupplyandcable,arelaidoutwithin1to1.5metersfromthetrunk;

（seven）withoutthecreationofcommercialserviceincitypublicgreenspaces,greenstallsrange;

（eight）otherdamagetourbangreeninganditsfacilities.

Eighteenthtreesinthecity,regardlessofwhethertheownershipofanyunitorindividualshallnotbecut,transplant,pruningandrootcuttingwithoutauthorization.Becauseofcountryconstruction,doneedtocut,transplant,pruning,mustbeapprovedbytheMunicipalGardensBureau

ormunicipalpeople'

sgovernmenttopaydamagesinaccordancewiththeprovisionsofthetrees,andinaccordancewiththe"

cuttingupthree,ensurethesurvivaloftheprincipleof"

plantingtrees.I
