§1PurposeandScopeoftheLaw

（1）ThepurposeofthisActistoprotectindividualsfromthatheisaffectedbythehandlingoftheirpersonaldatainhispersonalrights.

（2）ThisActappliestothecollection,processinganduseofpersonaldataby

（3）AsfarasotherlegislationoftheFederalapplytopersonaldataincludingtheirpublication,theytakeprecedenceovertheprovisionsofthisAct.Theobligationtorespectthelegalconfidentialityobligationsorofprofessionalorspecialofficialconfidentialitynotbasedonlegalregulationsremainsunaffected.

（4）TheprovisionsofthisActtakeprecedenceoverthoseoftheAdministrativeProcedureAct,insofarasindeterminingthefactspersonaldataareprocessed.

（5）ThisActshallnotapplyunlessachargeinanotherMemberStateoftheEuropeanUnionorinanothersignatorytotheAgreementontheEuropeanEconomicAreaestablishmentsituatedsitecollectspersonaldatainGermany,processesoruses,unlessthisisdonebyaestablishmentdomestically.ThisActshallapplyunlessaresponsibleentitythatisnotsituatedinaMemberStateoftheEuropeanUnionorinanothersignatorytotheAgreementontheEuropeanEconomicArea,collectspersonaldatainGermany,processesoruses.InsofarastheresponsibleentityunderthisActistobementioned,alsoprovideinformationondomestic-basedrepresentativesaretomake.Sentences2and3donotapplyifdisksareusedonlyforthepurposeoftransitthroughthecountry.§38para.1sentence1remainsunaffected.

§2Publicandprivateparties

（1）PublicbodiesoftheFederationaretheauthorities,theadministrationofjusticeandotherpublic-lawinstitutionsoftheFederation,thefederalcorporations,institutionsandfoundationsunderpubliclawaswellastheirassociationsirrespectiveoftheirlegalform.AspublicbodiesthatemergedfromthespecialfundGermanFederalPostOfficebylawcompaniesapplyaslongastheyhaveanexclusiverightunderthePostalAct.

（2）Publicauthoritiesofthecountry,theauthorities,theadministrationofjusticeandotherpubliclawinstitutionsofaLand,amunicipality,anassociationofmunicipalitiesandothersupervisionofthecountryunderstandingoflegalentitiesofpubliclawaswellastheirassociationsirrespectiveoftheirlegalform.

（3）private-lawassociationsofpublicauthoritiesofthefederalandstategovernments,carryoutthetasksofpublicadministration,applynotwithstandingtheparticipationofnon-publicentitiesaspublicbodiesoftheFederation,if

（4）Non-publicbodies,naturalandlegalpersons,companiesandotherassociationsofpersonsofprivatelawastheydonotfallunderparagraphs1to.3Takesaprivatebodyperformssovereignpublicadministrationduties,itistheextentofpublicauthoritywithinthemeaningofthisAct.

§3Otherdefinitions

（1）Personaldataisspecificinformationaboutpersonalorfactualcircumstancesofanidentifiedoridentifiablenaturalperson（datasubject）.

（2）Automatedprocessingisthecollection,processingoruseofpersonaldatausingdataprocessingequipment.Anon-automatedfileisnotanyautomatedcollectionofpersonaldatawhichissimilarlystructuredandwhichbyitscharacteristicsisavailableandcanbeevaluated.

（3）datacollectionistheacquisitionofdataonthepersonconcerned.

（6a）Pseudonymisationistoreplacethenameandotheridentificationfeaturesofanindicatorforthepurposeprecludethedeterminationofthepersonconcernedorsubstantiallymoredifficult.
